Terms and Conditions of Participation

Prize draw:

Among all orders placed from 1 June up to and including 30 June 2026, we will draw one winner of a high-quality outdoor table football table worth 5,200 Euro.

By taking part in the prize draw, the participant accepts the following terms and conditions.

1. Organiser and Controller

The organiser of the Garpa prize draw (hereinafter referred to as the “Prize Draw”) and the controller within the meaning of data protection law is Garpa Garten & Park Einrichtungen GmbH, Kiehnwiese 1, 21039 Escheburg, Germany (hereinafter “Garpa”). Further information about Garpa can be found in the legal notice.

Participation in the Prize Draw is subject exclusively to these Terms and Conditions of Participation.

2. Eligibility

Eligible to participate are persons resident in Germany, Austria or Switzerland who are at least 18 years old at the time of participation. Employees of Garpa and their relatives are excluded from participating in the Prize Draw. Each participant is entitled to enter the Prize Draw once only. Multiple entries or false information provided during registration may result in exclusion from the Prize Draw.

3. Participation

Participation in the Prize Draw takes place exclusively by placing an order with Garpa (e.g. in the Garpa online shop, by telephone or in our showrooms). By placing the order, the participating person agrees that the personal data transmitted for this purpose (name, address, contact details) may be stored and used for the purpose of notifying the winner and delivering the prize. Cancelled, returned or unpaid orders do not count as participation. One entry is counted for each completed order.

The participant also agrees that the data provided by them may be used by Garpa for marketing purposes, such as the sending of printed advertising materials.

4. End of the Prize Draw

The Prize Draw runs from 1 June up to and including 30 June 2026.

5. Determination of the Winner and Awarding of the Prize

The winner will be determined after the closing date by means of a random draw among all participants. The winner will then be notified in writing by email and/or by post using the address provided. Telephone contact with the winner is only possible if the winner has previously given their consent to this upon request by email. If the winner does not respond within 14 days of notification, the claim to the prize will lapse and a substitute winner will be determined using the same procedure. The participant is responsible for the accuracy of the email address provided. Cash payment, payment in other non-cash assets or exchange of the prize is not possible.

6. Liability

Claims for damages by the participant are excluded. We have unlimited liability for intent and gross negligence as well as in accordance with the German Product Liability Act. In cases of slight negligence, we are liable for damage arising from injury to life, limb or health. In cases of slight negligence, we are otherwise liable only in the event of a breach of a material contractual obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely (cardinal obligation). Liability for slight negligence is limited in amount to the foreseeable damage at the time the contract was concluded, the occurrence of which must typically be expected. This limitation of liability also applies for the benefit of our vicarious agents.

7. Data Protection Information

Personal data of the participant will be used exclusively for the performance of the prize draw contract, i.e. for determining the winner and delivering the prize (legal basis: Art. 6(1)(b) GDPR), and will subsequently be deleted three months after redemption of the prize. Any further use of the data for advertising purposes will take place only if the participant has given corresponding consent (legal basis: Art. 6(1)(a) GDPR).

You have the right to withdraw any consent once given to the processing of data at any time with effect for the future. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of the consent prior to withdrawal.

In addition to the right to withdraw the consents you have given us, you have the following further rights, provided that the respective statutory requirements are met:

• Right of access by the data subject pursuant to Art. 15 GDPR
• Right to rectification pursuant to Art. 16 GDPR
• Right to erasure pursuant to Art. 17 GDPR
• Right to restriction of processing pursuant to Art. 18 GDPR
• Right to data portability pursuant to Art. 20 GDPR
• Right to object to processing pursuant to Art. 21 GDPR

You also have the right to lodge a complaint with supervisory authorities. Further information on data protection, the Data Protection Officer and your rights as a data subject can be found here.

8. Final Provisions

Garpa reserves the right to suspend the Prize Draw, in whole or in part, if difficulties arise that jeopardise the integrity of the Prize Draw. Garpa will make use of this option in particular if, for technical or legal reasons, the proper conduct of the Prize Draw cannot be guaranteed.

German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the participant is a consumer resident in the European Union, the law of the country in which that person is resident may also apply where mandatory consumer protection provisions are concerned.

Should individual provisions of these Terms and Conditions of Participation be or become invalid, this shall not affect the legal validity of the remaining Terms and Conditions of Participation.

There is no right of appeal.
